Terms of Use

1. Agreement to these terms

These Terms of Use (the “Terms”) are a legal agreement between you and Pearlcuts (“Pearlcuts, ” “we,” “us,” or “our”) governing your use of the Pearlcuts mobile application and related services (the “App” or “Service”). They also serve as the end-user license agreement (EULA) for the App.

By downloading, accessing, or using Pearlcuts, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use Pearlcuts, and old enough to form a binding contract. By using the App you represent that you meet these requirements and that you will comply with these Terms and all applicable laws.

3. Your account

You can browse templates and styles, and purchase and generate videos, without creating a named account. When you first use the App we create an anonymous account on your device so your wallet and library work; this does not require you to share personal information.

Signing in with Google or Apple is optional and lets you sync your coins, subscription, and videos across your devices. You are responsible for keeping your sign-in method secure and for activity that occurs under your account. If your anonymous account is lost (for example, if you delete and reinstall the App without signing in), the coins and content tied to it may not be recoverable.

4. License to use the App

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple- or Google-branded devices that you own or control, for your personal, non-commercial use, in accordance with the usage rules of the applicable app store. We reserve all rights not expressly granted.

5. Coins, purchases, and subscriptions

Pearlcuts uses an in-app coin wallet. Generating a video spends coins. Coins are charged only for a successful generation — if a generation fails or is cancelled, your balance is not charged. Coins have no monetary value, are not redeemable for cash, and are non-transferable.

Subscriptions (auto-renewable)

You can subscribe to a plan that adds a recurring coin allowance to your wallet each billing period:

• Weekly Plan — $6.99 per week — 500 coins each week.
• Monthly Plan — $19.99 per month — 2,200 coins each month.

Prices are in U.S. dollars; prices in other regions are shown in the App and at checkout and may vary. These are auto-renewable subscriptions:

• Payment is charged to your Apple App Store (or Google Play) account at confirmation of purchase.
• The subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• You can manage or cancel your subscription, and turn off auto-renewal, in your App Store (or Google Play) account settings after purchase. The App links you to this native management screen (Profile › Subscription › Manage Subscription). Deleting the App does not cancel a subscription.
• Recurring coins are added at the start of each paid period. Coins from a subscription and coins bought as top-ups are spent from the same balance; unused coins remain in your wallet while your account is active.

One-time coin packs

You can also buy consumable coin top-up packs as a one-time purchase. These do not renew, and the coins are added to your wallet once payment is confirmed.

Payments, refunds, and changes

• All purchases are processed by the Apple App Store or Google Play and are subject to their terms. We do not receive or store your full payment-card details.
• Except where required by law or the applicable app store’s policies, purchases of coins and subscription periods are final and non-refundable. Refund requests are handled by the app store.
• We may change plans, pricing, or coin amounts going forward; changes do not affect a period you have already paid for, and material changes take effect on your next renewal.
• If you delete your account, any unused coins are forfeited and cannot be restored or refunded.

6. Acceptable use

You agree not to use Pearlcuts to:

• Upload content you do not have the rights to, or that infringes anyone’s intellectual property, privacy, or publicity rights.
• Upload or generate content depicting a real person without their consent, or content that is unlawful, defamatory, harassing, hateful, sexually explicit, or that exploits or endangers minors.
• Create content intended to deceive or impersonate, including misleading “deepfakes” of real individuals.
• Reverse engineer, decompile, scrape, overload, or interfere with the App or its security, or attempt to access it through unauthorized means or to obtain coins or features without paying.
• Violate any applicable law or the usage rules of the App Store or Google Play.

We may remove content and suspend or terminate accounts that violate these Terms.

7. Your content

You retain ownership of the photos you upload and, as between you and Pearlcuts, of the videos you generate. You grant us a limited license to host, process, and transmit your content as needed to operate the Service — including sending it to our AI provider to generate your video, and storing your results in your library — as described in our Privacy Policy.

You are solely responsible for the photos you upload and how you use the videos you create, and you represent that you have all rights and consents needed to do so.

8. AI-generated content

Pearlcuts generates videos using a third-party AI provider, xAI. Before any photo is sent, the App asks for your explicit permission and discloses what is sent and to whom. AI output is generated automatically and may be inaccurate, unexpected, or unsuitable for a given purpose.

• Generated videos are entertainment content created from your inputs. You are responsible for reviewing them before sharing.
• Do not rely on generated content as a depiction of real events, and do not use it to mislead others or in any unlawful way.

9. Our intellectual property

The App, including its software, design, templates, styles, branding, and all related intellectual property, is owned by Pearlcuts or its licensors and is protected by law. Except for the license granted to you above, these Terms do not transfer any of our rights to you.

10. App Store and third-party services

You download Pearlcuts from, and make purchases through, the Apple App Store or Google Play, and you use Google or Apple for optional sign-in and xAI for video generation. Your use of those services is also governed by their respective terms.

The following additional terms apply when you obtain the App from the Apple App Store (the “Apple” terms):

• These Terms are between you and Pearlcuts only, not with Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App. To the extent any warranty exists, if the App fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any) for the App; Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims relating to the App, including product-liability, legal/regulatory, or consumer-protection claims, or third-party claims that the App infringes intellectual-property rights.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-party list, and you will comply with applicable export laws.

Apple’s standard end-user license terms also apply where applicable; you can review them at apple.com/legal.

11. Disclaimers

The App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties regarding the accuracy or reliability of AI-generated output. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

12. Limitation of liability

To the maximum extent permitted by law, Pearlcuts and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

13. Indemnification

You agree to indemnify and hold Pearlcuts harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from the content you upload or generate, your use of the App, or your violation of these Terms or any law or third-party right.

14. Termination

You may stop using the App at any time and delete your account in Profile › Privacy & data. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

15. Governing law

These Terms are governed by the laws of the jurisdiction in which Pearlcuts is established, without regard to conflict-of-laws rules, and the courts of that jurisdiction will have exclusive jurisdiction, except where applicable consumer-protection law gives you the right to bring proceedings in your place of residence. Nothing in these Terms limits any non-waivable statutory rights you may have.

16. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, provide additional notice where required. Your continued use of the App after an update means you accept the revised Terms.
